I provide employment advice and representation to employees and senior executives in order to resolve employment disputes with their employer.
Employers normally win employment disputes because of the vast resources and finances they have at their disposal. Employees on the other hand often have limited finances and/or lack the confidence and knowledge to put their case forward.
I can provide the necessary support to enable you to put your case forward. This might involve me providing advice, drafting correspondence and reviewing documentation etc. Engaging the help of a HR consultant at the onset of a dispute may avoid incurring unnecessary legal fees.
If you would like to arrange an obligation-free telephone call to discuss your employment dispute, please contact me.
Below are some examples of the type of issues that I have helped employees to resolve:
- Grievance – Advised on how to raise a grievance; including drafting the grievance correspondence.
- Gross misconduct – An employee was facing the prospect of being terminated for gross misconduct, due to the Company elevating a minor misconduct issue. I assisted by drafting correspondence to help the employee to put forward their case.
- Disciplinary action – An employee who had previously raised a complaint found themselves being subjected to disciplinary action, due to shortfalls in their performance, none of which existed before the employee’s complaint was raised. I advised the employee to structure their grievance to demonstrate they had suffered an unlawful detriment for making a protected disclosure.
- Redundancy – An employee was made redundant, but the selection criteria was not fair. I advised the employee on the points to raise in their grievance and this led to the employer settling their dispute with a settlement agreement.
